Supreme Court has dismissed the petition by Obinna Uzoh challenging the election of Sen Ifeanyi Ubah, as the duly elected Senator, representing Anambra South Senatorial District.
A three-man panel of Justices of the appellate court led by Justice Stephen Adah decided to uphold the judgement of the Abuja Court of Appeal which had dismissed the decision of a lower court to sack Ubah from the National Assembly and hand over his certificate of return to close rival, Obinna Uzoh over issues bordering on fake certificate.
In the judgement on January 17, the Federal Capital Territory (FCT) high court in Kubwa had nullified Ubah”s election and ordered the INEC to withdraw the certificate of return issued to him. The court also ordered the electoral body to issue a fresh certificate to the candidate of the Peoples Democratic Party (PDP), Mr Uzoh who came second in the election, as the senator-elect of the district.
The Capital oil owner, however, got the judgment reversed at the Court of Appeal sitting in Abuja but the petitioner approached the apex court after after saying he was dissatisfied with the judgment of a three-member of the appellate court led by Justice Stephen Adah
